Please read these Terms of Service ("Terms") carefully before using LabourSampark ("Platform," "we," "us," "our," or "Company"). By accessing, browsing, or using LabourSampark, you agree to be bound by these Terms. If you disagree with any part of these Terms, please do not use our Platform.

1. Acceptance of Terms

By creating an account, uploading content, or using any features on LabourSampark, you:

• Acknowledge that you have read, understood, and agree to be bound by these Terms
• Confirm that you are at least 18 years of age and have the legal authority to enter into this agreement
• Accept our Privacy Policy and other associated policies
• Agree that these Terms supersede any previous agreements between you and LabourSampark

2. User Accounts and Registration

2.1 Account Creation

• You must provide accurate, complete, and current information during registration
• You are responsible for maintaining the confidentiality of your password
• You agree to notify us immediately of any unauthorized access to your account
• You are solely responsible for all activities conducted through your account

2.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in prohibited conduct. Upon termination, your right to use the Platform immediately ceases.

2.3 Multiple Accounts

You may not create multiple accounts without our explicit permission. Using multiple accounts to circumvent limitations or engage in fraudulent activity is prohibited.

3. User Types and Roles

3.1 Labourers

Skilled workers offering their services through the Platform. Labourers agree to:

• Provide accurate information about skills, experience, and availability
• Respond to work inquiries in a timely manner
• Maintain professional conduct and quality of work
• Honor agreements made with contractors

3.2 Contractors

Individuals or businesses seeking labour services. Contractors agree to:

• Provide accurate project details and requirements
• Communicate professionally with labourers
• Pay agreed-upon compensation on time
• Respect the agreed-upon scope of work

4. Prohibited Conduct

You agree NOT to:

• Violate any applicable laws, regulations, or third-party rights
• Harass, threaten, defame, or abuse other users
• Post false, misleading, or fraudulent information
• Engage in any form of discrimination or hate speech
• Attempt to hack, exploit, or gain unauthorized access to the Platform
• Upload malware, viruses, or harmful code
• Spam, phishing, or engage in unsolicited commercial activity
• Impersonate another person or entity
• Conduct transactions outside the Platform to avoid fees or oversight
• Manipulate ratings, reviews, or user feedback
• Engage in child exploitation or abuse
• Violate intellectual property rights

5. Verification and Background Checks

• We may conduct background checks for safety purposes
• You authorize us to verify Aadhar and government IDs
• Verification does not guarantee absolute safety or quality
• We reserve the right to reject applications or remove users based on verification results
• Providing false information during verification is grounds for immediate termination

6. Payments and Fees

6.1 Payment Processing

• We use third-party payment processors to handle transactions
• Payment details are processed securely and are subject to payment processor terms
• We are not responsible for payment processor failures or delays

6.2 Platform Fees

• LabourSampark may charge service fees for platform usage
• Fees are clearly displayed before transaction completion
• Fee structure may change with 30 days' notice

6.3 Refunds and Disputes

• Refund requests must be submitted within 30 days of transaction
• Refunds are processed within 5-7 business days
• We will investigate payment disputes fairly and impartially

7. Intellectual Property Rights

• LabourSampark retains all intellectual property rights to the Platform, content, and design
• Your user-generated content (photos, descriptions) is licensed to us for Platform operation
• You retain ownership of your intellectual property but grant us a perpetual, royalty-free license
• You may not reproduce, distribute, or sell Platform content without authorization

8. User-Generated Content

8.1 Responsibility

You are solely responsible for any content you upload, post, or share. We do not endorse, review, or validate user-generated content before publishing.

8.2 Rights to Remove Content

We reserve the right to remove content that violates these Terms or applicable laws without notice.

8.3 Warranty

You warrant that you own or have all necessary rights to the content you share and that it does not infringe on any third-party rights.

9. Ratings and Reviews

• Users may leave ratings and reviews based on their experience
• Reviews must be honest and based on actual interactions
• False, defamatory, or harassing reviews will be removed
• Users cannot incentivize positive reviews or discourage negative reviews
• LabourSampark is not responsible for the accuracy of user reviews

You agree to indemnify and hold harmless LabourSampark, its owners, employees, and agents from any claims, damages, losses, or liabilities arising from:

• Your violation of these Terms
• Your use or misuse of the Platform
• Your user-generated content
• Your infringement of third-party rights

12. Dispute Resolution

12.1 Informal Resolution

Before filing any formal claim, parties agree to attempt in good faith to resolve disputes informally through communication.

12.2 Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with applicable laws, except for claims related to intellectual property rights.

12.3 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective 30 days after posting on the Platform. Your continued use constitutes acceptance of modified Terms. Material changes will be communicated via email.

14. Termination

• Users may delete their account at any time through account settings
• LabourSampark may suspend or terminate accounts for violating these Terms or applicable laws
• Upon termination, access ceases immediately, but certain provisions survive

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in effect to the maximum extent permitted by law.
